Spouses indicted for drug possession
CEBU, Philippines — The Office of the Cebu City Prosecutor has recommended the filing of charges to the court against a couple for illegal possession of dangerous drugs.
Prosecutor III Rhodna Alcala-Bacatan held spouses Roy and Veronica Cabahay, residents of Sitio Looban, Villagonzalo II, Barangay Tejero, Cebu City for trial after finding probable cause for violation of Section II (possession of shabu) of the Article II of Republic Act 9265 or Comprehensive Dangerous Drugs Act.
“…that the accused was given a chance to submit controverting evidence, that on the basis of the evidence presented, there is a reasonable ground to believe that the crime has been committed and that the accused is probably guilty thereof,” Bacatan ruled.
On July 18, 2018, the Waterfront Police enforced the search warrant issued by Regional Trial Court Judge Ramon Daomilas, Jr. against the couple in their residence.
Upon arrival the operatives, the couple sensed their presence and immediately closed and locked the door.
The operatives used reasonable force to open the door.
However, the couple has already escaped through a hole that connects to some houses at the interior portion of said place.
The operatives were able to recover 47 heat-sealed plastic sachets containing shabu weighing 65.8217 grams and drugs paraphernalia.
Bacatan issued a subpoena and directed the couple to file counter-affidavit but failed. Thus, she resolved the complaint based on the evidence at hand.
With the foregoing, Bacatan found probable cause against the couple.
“The uncontested evidence on record sufficiently established probable cause against respondents for possessing illegal drugs and drugs paraphernalia,” read the resolution.
There is no bail recommended for the case of possession of illegal drugs but Bacatan recommended a bail of P40,000 each for possession of drug paraphernalia. (FREEMAN)
